Hi. We are two twin brothers. We are modders on moddb for Quake 2 Dawn of Darkness, a total conversion with a arabian setting, a free mod made by Ward Six Entertainment in 1999. Many things have happened from where the project has ceased production. Also EricBoyceU works independently and made a text addon for the mod. The video is a old work in progress. With my brother, i made a .qrk file for Quark editor, so the people can make levels further. I already done some work for a upcoming Prince of Persia Dawn of Darkness mod.

The original DOS games are no longer profitable and can probably be classed as abandonware (itself a legal gray area), but they're still subject to copyright. So if you intend to profit from the mod in any way then legally, no, you cannot use the original game assets without the copyright owner's permission obviously. Even if you don't intend to profit from it the copyright owner may still legally object.
